Registered Offender Language Now Required In Contracts

During the 2006 Legislative Session, the Kansas Legislature passed legislation that requires new disclosure language in all residential real estate contracts on the possible presence of registered offenders near the property.   Starting on July 1, 2008, every residential real estate contract used in this state must contain the following word-for-word language that can be found in the real estate license law at K.S.A. 58-3078:

“Kansas law requires persons who are convicted of certain crimes, including certain sexually violent crimes, to register with the sheriff of the county in which they reside.  If you, as the buyer, desire information regarding those registrants, you may find information on the homepage of the Kansas Bureau of Investigation (KBI) at http://www.Kansas.gov/kbi or by contacting the local sheriff’s office.”  

Over the course of the past year, KAR has been working with our Local Boards to ensure that this language is included in all board-approved residential real estate contracts.  However, if you have not already added this language into your standard residential real estate contract, you must do so immediately in order to comply with the approaching deadline.
