Kansas Real Estate Commission Has Determined That All
Compensation for BPOs and CMAs Must Flow Through the
Supervising Broker
(July 28)  Earlier this month, the Commission determined that
all compensation for brokers' price opinions (BPOs) and
comparative market analyses (CMAs) completed by real estate
salespersons and associate brokers must flow through the
broker.  As a result, if you are a salesperson or associate
broker that receives compensation for a BPO or CMA, that
compensation must be paid to the supervising broker just like
a real estate commission.

Kansas Real Estate Commission Adopts New Restrictions on
Advertising by Real Estate Salespersons, Associate Brokers
and Teams

(July 14)  During the 2008 Legislative Session, the Kansas
Legislature passed HB 2746 that made several major changes
to the statutes and regulations governing advertising by real
estate licensees.  Under this legislation, the Commission will
require all advertising conducted by real estate licensees to
prominently display the name of the supervising brokerage.
In addition, the Commission will prohibit the use of terms such
as "real estate" and "realty" in team names.

(July1)  The Commission has issued new rules on when real
estate licensees must disclose if they have an interest in the
property subject to the transaction.
