Effective July 1, 2004, the prohibition on a licensee offering or giving gifts and gratuities was repealed. However, other laws continue in effect that prohibit certain types of gifts and gratuities from being offered. Real estate licensees should be cognizant of the KREC Guidelines and Statutes.
According to the Kansas Real Estate Commission, each transaction file whether PENDING, CLOSED, FAILED, or CANCELLED must be indexed by TIN and by client or customer name. Each file should contain a number of records to the transaction to be in compliance with K.A.R. 86-3-10 and shall be retained for a period of 3 years. Check out the KREC Guidelines.
The use of unlicensed personal assistants in the real estate industry is a growing trend. Busy salespersons and associate brokers often see a practical need to have assistants to help. KREC has developed guidelines in response to inquiries regarding the use of unlicensed personnel to perform certain tasks. While the guidelines address many of the situations faced by real estate licensees and their unlicensed co-workers in daily practice, they are not intended to apply universally in all circumstances. Brokers are advised to consult their attorneys when in doubt.
